Welcome to Kloud Team. These Terms of Service govern your access to and use of our GPU cloud platform, services, and related infrastructure. By accessing or using our services, you agree to be bound by these terms.
If you do not agree to these terms, you may not access or use our services. We reserve the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any changes.
To use our services, you must create an account. You are responsible for maintaining the security of your account and for all activities that occur under your account:
- You must be at least 18 years old or the age of majority in your jurisdiction to use our services
- You are responsible for maintaining the confidentiality of your account credentials
- You must immediately notify us of any unauthorized access or security breach
- You must provide accurate, current, and complete information during registration
You agree to use our services in compliance with all applicable laws and regulations. Our platform is designed for legitimate cloud computing and AI workloads.
The following activities are strictly prohibited:
- Any illegal activities or violation of laws and regulations
- Activities that harm, threaten, or harass others, or violate their privacy
- Attempts to interfere with, disrupt, or compromise our infrastructure or other users' access
- Cryptocurrency mining or similar resource-intensive operations without prior authorization
- Unauthorized access, probing, or testing of our systems for vulnerabilities
We strive to provide reliable and high-quality GPU cloud services, but we cannot guarantee uninterrupted availability:
- We may perform scheduled maintenance with advance notice when possible
- We reserve the right to modify, suspend, or discontinue any aspect of our services
- Service availability may vary based on region, resource availability, and demand
For enterprise customers with Service Level Agreements (SLAs), specific uptime guarantees and remediation procedures are outlined in your contract.
Our services operate on a credit-based system. You agree to pay all fees and charges associated with your use of our services:
- Pricing is based on resource usage including GPU time, compute resources, storage, and network transfer
- You will be charged based on actual usage, calculated hourly for running resources
- Credits must be purchased in advance and are consumed as you use resources
- Credits are generally non-refundable except as required by law or at our sole discretion
- We reserve the right to suspend services for accounts with insufficient credits or payment issues
Kloud Team retains all rights, title, and interest in our platform, services, technology, and related intellectual property. Your use of our services does not grant you any ownership rights to our platform or technology.
Your Content:
You retain all rights to any code, data, models, or content you deploy or store on our platform. By using our services, you grant us a limited license to host, store, and process your content solely to provide our services. We do not access, view, or use your content for any other purpose.
To the maximum extent permitted by law, Kloud Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use or inability to use our services.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
You agree to indemnify and hold Kloud Team harmless from any claims, damages, or expenses arising from your use of our services, your violation of these terms, or your violation of any rights of another party.
We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, for any violation of these terms or for any other reason at our sole discretion. Upon termination, your right to use our services will immediately cease.
Governing Law:
These terms are governed by and construed in accordance with applicable laws. Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration or in courts of competent jurisdiction.
Changes to Terms:
We may update these Terms of Service from time to time. We will notify you of any material changes by posting the new terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes your acceptance of the updated terms.
